Terms of Use — Rascalorie

These terms are a contract between you and Yury Atrashkevich, Afrikis 26, 3052 Limassol, Cyprus ("we", "us"), covering the Rascalorie app and service. By using the app you accept them. If you do not, please do not use the app.

1. This is not medical advice

Rascalorie is a calorie and habit tracking tool. It is not a medical device, not a diagnosis, and not a substitute for advice from a doctor or dietitian.

In Recommended mode, calorie targets are estimates produced from the details you enter (sex, age, height, weight, activity, goal and pace) using standard formulas. They may adapt over time from what you log and can be wrong. In Custom mode, you set a fixed base food budget; goal, pace, weight trend, learned burn and weekly redistribution do not change that base, although logged activity can extend the calories available today.

Both modes enforce a safety floor: 1200 kcal for women or 1400 kcal for men. In Recommended mode, a pace that would go below it is clamped and the projected date stretches instead. A lower Custom value cannot be saved.

Do not use this app to pursue rapid or extreme weight loss. If you are under 18, pregnant or breastfeeding, have or have had an eating disorder, diabetes, kidney or heart disease, or take medication affecting appetite or metabolism, please talk to a professional before changing how you eat. If you feel unwell, stop and seek medical help.

2. Who may use it

You must be 18 or older. By using the app you confirm you are. The app will not accept a lower age, and we will delete an account we learn belongs to a minor.

3. Your account

You are responsible for keeping your password safe and for activity under your account. Tell us at hello@rascalorie.com if you think someone else has access. We may suspend an account that is being used to attack, defraud or abuse the service.

4. What is free and what is paid

Free, with no time limit: manual food and movement logging, your choice of a Recommended or Custom calorie budget, weight trend, history, water and sleep tracking, and your saved foods.

Free also includes your first 3 AI checks — once per account, not per day, so you can see what the coach actually does before deciding anything.

Pro then unlocks the AI features: the coach chat, menu scanning, meal photo reads, taste preferences, the projected finish date, and patterns behind hungry and over-budget days. Features we add later may join Pro; we will say so in the app before they do.

5. Subscriptions, trial and billing

• Prices at the time of writing: $8.99 per month and $39.99 per year. Prices shown in the app in your local currency always take precedence.
• A 7-day free trial is available for new subscribers whom Apple finds eligible. Apple grants one introductory offer per subscription group per customer, so if you have used a trial on this app before, you will be charged from day one; the app asks Apple first and only offers the trial when the answer is yes. The trial and any discounted first period are mutually exclusive.
• Payment is charged to your Apple ID at confirmation. Subscriptions renew automatically unless auto-renew is switched off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You manage and cancel subscriptions in your Apple ID settings, not in the app. Deleting the app does not cancel a subscription.
• If you cancel during a free trial, you are not charged. Any unused part of a free trial is forfeited when you buy a subscription.
• Refunds are handled by Apple under their terms. We cannot issue refunds for App Store purchases, though we will help you with the request.

6. Fair use of the AI features

AI features cost us money per request, so they carry a fair-use limit of 50 AI checks per day per account. This is an anti-abuse ceiling, not a rationing device: ordinary use, including heavy use, stays far below it.

Two other limits can also refuse an AI request, and it is fairer to name them than to let you meet them as a mystery error. First, we keep a ceiling on what the whole service spends on AI in a single day; if it is reached, AI features pause until the next day for everyone and the app says exactly that. Second, photo and menu scanning require an account — the anonymous "try it free" session can use the text coach but not the camera, because an anonymous request that costs us money per image is the one thing a script can abuse without limit.

We may adjust these limits if costs change materially or if they are being circumvented, and we will give notice in the app before a reduction to the per-account limit takes effect. Automated access, scripted requests and sharing one account between several people are not permitted.

7. AI output

The AI produces estimates. Calorie and macro figures, menu picks and cooking feedback can be inaccurate, particularly for homemade dishes, mixed plates and unusual portions. Check anything that matters, and never rely on the app for an allergy or medical decision. Photo checks while cooking do not assess food safety — use a thermometer and your own judgement.

8. Your content

Your logs, photos and notes remain yours. You grant us only the licence needed to run the service: to store your data, to sync it to your devices, and to transmit photos and descriptions to our AI provider for processing so we can return a result to you. We do not use your content to train models, and we do not publish it.

Do not upload anything unlawful, or images of other people without their agreement.

9. Availability and changes

We may change, suspend or discontinue features. If we discontinue something you paid for, or make a material change to these terms, we will tell you in the app in advance. We aim to keep the service running but do not guarantee uninterrupted availability; third-party services we depend on can fail.

10. Ending it

You can stop at any time: delete your account in Settings, and cancel any subscription through Apple. Deleting erases the account from our servers and clears the app on the phone you do it from, so export your data first if you want to keep a copy — the privacy policy sets out exactly what survives and why. We may terminate an account that breaches these terms, and we will explain why unless we are legally prevented.

11. Disclaimers and liability

The service is provided "as is". To the fullest extent permitted by law we exclude implied warranties, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. Nothing here limits the statutory rights of consumers.

12. Governing law

These terms are governed by the laws of the Republic of Cyprus, and disputes go to the courts of Cyprus. If you are a consumer in the EEA/UK, you keep the protection of the mandatory rules of your country of residence.
